Terms of Use

Last updated:

These terms govern your use of Dear Car, the app and this website, operated by Qusai Eilouti. By creating an account you agree to them. Questions go to support@dearcar.app.

Your account

You must be at least 13 years old, and old enough to agree to these terms where you live. You sign in with Apple, with Google, or with an email address and a password, and the address must be yours. Keep your password, and the Apple or Google account you sign in with, secure: anyone who can use them can use Dear Car as you. If you think someone else has used your account, sign out your other devices under Your devices, change your password, and tell us.

Garages and sharing

A garage holds cars and the people who share them. Everyone in a garage can see and change its records. The owner can rename the garage, invite people, turn off invite links and remove members. Share invite links only with people you mean to invite, and add information about someone else, such as a family member’s driving licence expiry, only if you have the right to.

Your content

The records, photos and documents you add stay yours. You allow us to store, process and show them only as needed to run Dear Car for you and the people in your garage. You are responsible for what you upload: nothing unlawful, and nothing you have no right to share.

Shared costs

When a garage’s owner turns on cost sharing, Dear Car splits the costs members log and shows who owes whom. These are records to help you settle up, not payments: Dear Car does not move money, check that anyone has paid, or settle debts for you. Check amounts with each other and sort out disagreements between yourselves.

Reminders and estimates are aids

Odometer estimates, service intervals, due dates, litres worked out from the price you paid last time, and consumption figures are estimates based on what you enter and on general templates. The paperwork, fuel grades and service schedules we suggest for your garage’s country are general guides too: they may be incomplete, out of date or different from the rules where you live. None of this is professional or legal advice. Follow your car maker’s schedule and your mechanic’s advice, and keep track of legal deadlines, such as registration, licence, inspection, road tax and insurance renewals, yourself. Reminders depend on your phone, its settings and its connection, and may be late or not arrive. We are not responsible for fines, damage or costs caused by a missed or wrong reminder or estimate.

The free garage and the Garage plan

A free garage holds one car, one person and up to 30 documents, and each person can be in one free garage. The Garage plan, sold through the App Store and Google Play as a monthly or a yearly subscription, lets one garage you own hold up to five cars and six people, with unlimited documents within fair use of 2 GB per garage, and the yearly report. Monthly and yearly include exactly the same things; only the price and how often you pay differ. People join a garage on the plan for free.

Prices are set for each country and can differ between countries. Your store shows the price in your local currency, with any taxes that apply, before you buy, and charges your Apple or Google account when you confirm the purchase.

The subscription renews automatically at the end of each period, every month or every year depending on which you chose, at the price your store then shows, unless you turn off auto-renewal at least 24 hours before the current period ends. Your store account is charged for each renewal around the end of the current period (Apple charges within the 24 hours before it ends). If the price changes, the new price applies from a later renewal, and your store tells you beforehand where its rules or the law require it.

You can turn off auto-renewal or cancel in your Apple or Google account’s subscription settings. On Apple devices you can also switch between monthly and yearly there, and Apple decides when a switch takes effect, usually at the next renewal; on Google Play, cancel and choose the other option in the app when the paid period ends. When you cancel, the plan stays on until the end of the month or year you have paid for. Deleting the app or your account does not cancel the subscription. You can restore the plan on a new phone by signing in to the same Dear Car account.

Apple and Google handle billing and refunds under their own policies. Nothing in these terms takes away a right to cancel, withdraw or get a refund that the consumer law of the country where you live gives you.

If the plan ends, nothing is deleted, and the garage goes back to the free garage. One car stays active: until the owner picks it, the car with the most recent entry. The other cars become read-only: everything on them can still be seen and exported, but nothing new can be added. The owner keeps the garage; other members stay members but cannot open it, and get no reminders from it, until the plan is renewed. Reminders keep coming for every car to the people still in, and repayments can still be recorded. The owner can change the active car once every 30 days. Buying the plan again unlocks everything at once. Records, reminders and CSV export are never behind a paywall.

Files

Each file can be up to 10 MB. We may limit uploads that go far beyond fair use or that put the service at risk.

Acceptable use

Do not misuse Dear Car: no unlawful content, nothing harassing, hateful or sexually explicit, no sharing of someone’s personal information without their consent, no attempts to reach garages you are not in, no automated access or attempts to get around limits, and no interfering with the service or reverse engineering it beyond what the law allows. A garage’s owner can remove anyone from it, and anyone can leave. Tell us about abuse at the address above and we will look into it.

Suspension

We may suspend or close an account that breaks these terms, misuses invite links, or puts other people or the service at risk. Unless the law or safety prevents it, we will tell you why and give you the chance to export your records first.

The service

Dear Car works in any country. Your garage’s country sets its currency, units, fuel grades, paperwork names and service schedule. Dear Car needs an internet connection; this version does not work offline. Reminders depend on Apple’s and Google’s notification services and your phone’s settings. We may change, add or remove features; if we ever stop running Dear Car, we will tell you at least 30 days before, so you can export your records. We work to keep the service available and your data safe, but we cannot promise it will always be available or free of errors. Keep your own copies of documents that matter to you; you can export your records to CSV at any time.

Leaving

You can stop using Dear Car and delete your account in the app at any time. What happens to your data is described in the Privacy Policy and on Delete your account.

No warranty

Dear Car is provided “as is” and “as available”, without warranties of any kind, to the extent the law allows.

Liability

To the extent the law allows, we are not liable for indirect or consequential losses, or for losses caused by relying on reminders or estimates. Our total liability for any claim about Dear Car is limited to what you paid for the Garage plan in the twelve months before the claim. Nothing in these terms limits liability that cannot be limited by law, or your rights as a consumer.

Disputes

If you use Dear Car as a consumer, you keep the protection of the mandatory consumer laws of the country where you live, and you can bring a claim in the courts there where those laws allow it. Before you start a claim, please write to us so we can try to solve the problem.

Changes

We may update these terms. We will tell you in the app or by email before a significant change takes effect, and the date at the top shows the current version. Using Dear Car after an update means you accept it; if you do not, you can stop using it and delete your account.

App Store and Google Play

If you downloaded Dear Car from Apple’s App Store, Apple’s standard Licensed Application End User License Agreement also applies, and Apple has no obligation to provide support for the app. If you downloaded it from Google Play, Google Play’s terms of service also apply to your download and purchases.
